1. Scope
Sporfia provides an online marketplace where independent sellers may upload product listings, photographs, graphics, videos, descriptions, logos and other content.
This Policy applies to copyright complaints concerning content displayed through Sporfia, including:
- Product photographs.
- Artwork and illustrations.
- Clothing and merchandise designs.
- Product descriptions.
- Store logos and branding.
- Videos and promotional content.
- Print-on-demand designs.
- Other user-submitted material.
This Policy does not determine ownership disputes between private parties. Sporfia may remove or restrict content while the parties resolve their disagreement.
2. Seller responsibility
Sellers may upload or use content only when they own the applicable rights or have valid permission from the rights holder.
Sellers may not:
- Copy another seller’s photographs or descriptions without permission.
- Use copyrighted artwork, characters, photographs or designs without authorization.
- Offer print-on-demand merchandise containing unauthorized protected content.
- Remove or alter ownership notices or watermarks.
- Claim ownership of content created by another person.
- Use content copied from social media, search engines or another marketplace merely because it is publicly visible.
- Misrepresent a product as officially licensed or affiliated.
Sellers should retain licenses, invoices, authorization letters, design files and other evidence supporting their right to use marketplace content.
3. Reporting suspected infringement
A copyright owner or authorized representative may send Sporfia a written notice identifying content believed to infringe copyright.
Notices should be sent to:
Questions about orders, shipping, returns or seller support should be sent to support@sporfia.com.
4. Copyright notice requirements
A complete copyright infringement notice should include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the allegedly infringing content with enough information for Sporfia to locate it, such as the specific product URL.
- The complaining party’s full name, mailing address, telephone number and email address.
- A statement that the complaining party has a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
A notice should also include any supporting information that may help Sporfia evaluate the complaint, such as:
- Copyright registration information.
- Links to the original work.
- Publication dates.
- Licensing records.
- Comparison images or screenshots.
- Information identifying the seller or store.
Incomplete notices may delay review. Sporfia may request additional information before acting.
5. Review and removal process
After receiving a sufficiently complete notice, Sporfia may review the identified content and take appropriate action.
Sporfia may:
- Temporarily restrict or remove the identified listing.
- Disable access to specific images, descriptions or files.
- Notify the affected seller.
- Request proof of ownership, authorization or licensing.
- Preserve relevant account and transaction records.
- Suspend the seller’s ability to publish additional listings.
- Restore content when appropriate.
- Take additional action under the Seller Agreement or other marketplace policies.
Removal of a listing does not necessarily mean that Sporfia has made a final legal determination regarding ownership or infringement.
6. Counter-notification
A seller whose content was removed or restricted as a result of a copyright complaint may submit a written counter-notification when the seller believes the content was removed because of mistake or misidentification.
A complete counter-notification should include:
- The seller’s physical or electronic signature.
- Identification of the content that was removed or restricted and the location where it previously appeared.
- A statement under penalty of perjury that the seller has a good faith belief the content was removed because of mistake or misidentification.
- The seller’s full legal name, address, telephone number and email address.
- A statement consenting to the jurisdiction of the appropriate United States federal court and accepting service of process from the person who submitted the original notice or that person’s agent.
Sporfia may provide the counter-notification to the original complaining party.
Sporfia may restore the content after the applicable waiting period unless the complaining party notifies Sporfia that court action has been filed seeking to restrain the allegedly infringing activity.
Sellers should not submit a counter-notification unless they genuinely believe the removal resulted from mistake or misidentification. Sellers may wish to consult an attorney before submitting one.
7. Repeat infringer policy
Sporfia may suspend or terminate sellers and other users who repeatedly infringe intellectual-property rights or repeatedly upload content that generates valid infringement complaints.
In determining whether action is appropriate, Sporfia may consider:
- The number and frequency of complaints.
- The seriousness of the alleged infringement.
- Whether the seller removed or relisted content.
- Evidence provided by the rights holder.
- Evidence provided by the seller.
- Prior warnings or marketplace violations.
- Whether the seller attempted to avoid enforcement.
Sporfia may act immediately in cases involving counterfeit products, deliberate infringement or significant legal risk.
8. False, misleading or abusive claims
Copyright notices and counter-notifications must be submitted honestly and in good faith.
A person who knowingly misrepresents that content is infringing, or knowingly misrepresents that content was removed by mistake, may be responsible for resulting damages or other legal consequences.
Sporfia may reject, restrict or report complaints that appear fraudulent, abusive, retaliatory or intended to interfere unfairly with another seller.
Submitting a copyright complaint is not an appropriate method for resolving:
- Pricing disputes.
- Product-quality complaints.
- Personal disagreements.
- Contract disputes unrelated to copyright.
- Competition between sellers.
- Trademark-only complaints.
9. Trademark and other intellectual-property complaints
Trademark, patent, publicity-right and other intellectual-property complaints may also be submitted to Sporfia.
A trademark complaint should identify:
- The trademark owner.
- The registered or claimed mark.
- Applicable registration numbers.
- The country or jurisdiction of registration.
- The allegedly infringing product URL.
- How the listing creates infringement or confusion.
- The complaining party’s contact information.
- Evidence of authority to act for the owner.
Trademark complaints may be sent to the same email address listed for the Copyright Agent unless Sporfia provides a separate reporting method.
Sporfia may request additional documentation before restricting a listing.
10. Records, disclosure and cooperation
Sporfia may retain infringement notices, counter-notifications, communications, listing records and related account information as reasonably necessary for:
- Policy enforcement.
- Repeat-infringer determinations.
- Fraud prevention.
- Legal compliance.
- Dispute resolution.
- Protection of marketplace users.
Sporfia may share a complaint or counter-notification with the affected seller, complaining party, legal representatives, service providers or governmental authorities when reasonably necessary or legally required.
Information submitted in a complaint should therefore be limited to information relevant to the claim.
11. Changes to this Policy
Sporfia may update this Policy to reflect changes in law, marketplace operations, reporting procedures or intellectual-property enforcement practices.
The effective date displayed at the top of this page identifies the current version.
